Everything you need to know about orders, returns, commissions, and how WiggleKin handles your personal data.

Introduction

Welcome to WiggleKin.com (the “Site”). The Site is operated by Gozo Graphics Ltd. trading as WiggleKin (“WiggleKin”, “we”, “us”, “our”).
WiggleKin is Gozo Graphics’ collectible toy and display line within the ARX family. By using the Site you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site.
We may update these Terms from time to time without prior notice. Continued use of the Site constitutes acceptance of the updated Terms.
Section A sets out the Terms and Conditions (including website use, orders, fulfilment, returns, and commissions); Section B sets out our Privacy Policy for WiggleKin.com; Section C explains how to notify us if you wish to exercise an eligible right of withdrawal.

Section A — Terms and Conditions

1) WiggleKin Product Characteristics

• WiggleKin items are collectible 3D printed products designed and produced in-house in Gozo, Malta.
• Because each item is manufactured layer-by-layer, minor layer lines, light texture variation, tiny colour artifacts, and small finishing differences are normal characteristics of the process and do not by themselves mean that an item is faulty.
• Product photos, renders, mockups, and on-screen previews are indicative only. Final appearance may vary slightly due to screen settings, lighting, material behaviour, finishing tolerances, and the nature of 3D printing.
• Unless otherwise stated, all product dimensions, colours, weights, and visual representations are approximate.

1.1) Handmade / 3D Printed Variation — Clarification

WiggleKin products are not injection-moulded mass-produced items. Small visible differences between units, including subtle surface texture, seam placement, or tiny print-related marks, are part of the collectible nature of the product. This clause does not affect any rights you may have if a product is actually defective, damaged, not as described, or otherwise not in conformity with applicable law.

2) Orders, Availability, and Acceptance

• Some WiggleKin products are held in stock for immediate dispatch, while others are produced on demand or in limited print batches.
• We reserve the right to refuse, cancel, or limit an order where there is an obvious pricing error, unexpected stock shortage, suspected fraud, content/design issue, or other legitimate reason.
• Your order is not considered accepted until payment has been successfully received or otherwise approved by us.
• Where a custom commission or made-to-order item is requested, production begins only once the order details are sufficiently confirmed and any required payment has been received.

2.1) Payment

• Prices are in Euros (€) unless otherwise stated.
• By placing an order, you agree that all applicable charges, taxes, shipping fees, and processing fees will be charged to your selected payment method or otherwise paid by an agreed method.
• We may suspend production, withhold dispatch, or postpone collection until payment is received in full.
• Where a deposit or staged payment arrangement is agreed for custom or large-format work, the remaining balance must be paid as agreed before dispatch, installation, or collection unless we confirm otherwise in writing.

2.2) VAT Policy

Gozo Graphics Ltd. is registered for VAT in Malta. VAT is charged where applicable in accordance with law and is included in pricing where stated on the Site. Fiscal receipts and/or invoices are issued as appropriate once payment is effected.

3) Production, Lead Times, and Fulfilment

• For items in stock, orders are usually processed promptly after payment confirmation.
• For items being printed on demand, please allow approximately 3–5 business days for production before dispatch unless a different timeframe is stated on the product page or agreed in writing.
• Large-format mascots, giant event displays, and bespoke commissions may require longer lead times and may be quoted separately.
• During tournament periods, viral demand spikes, maintenance, supply interruptions, or periods of high batch congestion, production and dispatch times may be longer than usual.
• All turnaround times, processing times, dispatch dates, and delivery dates shown on the Site or in communications are estimates unless we expressly confirm a guaranteed deadline in writing.

3.1) Batch Production

Certain WiggleKin products are manufactured in grouped print runs to maintain consistency and quality. Batch scheduling, machine availability, colour changes, and print-farm capacity may affect turnaround times.

4) Shipping, Delivery, and Collection

• We aim to ship worldwide where shipping services are available, but available destinations and courier options may change from time to time.
• You are responsible for providing a complete and accurate shipping address and contact details.
• We are not responsible for delays caused by carriers, customs authorities, weather, strikes, public events, or other circumstances beyond our reasonable control.
• For international shipments, you are responsible for any customs duties, import taxes, brokerage fees, clearance charges, or similar destination-country charges unless we expressly state otherwise.
• If collection is offered, collected orders should be picked up within a reasonable time after notice that they are ready.

5) Returns, Cancellations, and Right of Withdrawal

If you are a consumer and you buy a standard, non-personalised item online from us, you may have the legal right to withdraw from the purchase within 14 days from the day you (or a person you nominate) receive the goods, without giving any reason.

• To exercise an eligible right of withdrawal, please email dragons@wigglekin.com before the end of the 14-day period with the details listed in Section C.
• You must send back the goods without undue delay and no later than 14 days after notifying us of your decision to withdraw, unless we agree otherwise in writing.
• Unless the item is faulty, not as described, or we agree otherwise, you are responsible for the direct cost of returning the goods.
• Returned goods should be adequately packaged. You are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
• Where a withdrawal is valid, we will reimburse the price paid and the original standard outbound delivery charge where required by law. We may withhold reimbursement until we receive the goods back or until you provide evidence that they have been sent back, whichever is earlier.

5.1) Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where permitted by law to goods made to your specifications or clearly personalised. This includes, without limitation:

• custom commissions made to your requested colours, logos, names, text, or design instructions;
• bespoke mascots or made-to-order display builds created to your requested specification;
• giant event displays, installations, or special builds once production has begun.

5.2) Cancellations Before Production

• You may request cancellation before production begins.
• If work has already started on a bespoke, personalised, or special-order commission, we may refuse cancellation or deduct reasonable non-recoverable costs already incurred, to the extent permitted by law.
• Once production of a custom or personalised order has begun, that order is generally non-cancellable and non-refundable except where required by applicable law.

6) Faulty, Damaged, or Non-Conforming Goods

• Please inspect your order promptly upon delivery and contact us at dragons@wigglekin.com if an item arrives damaged in transit, appears faulty, is incomplete, or does not match the confirmed order.
• To help us assess the issue, please include your order number, a description of the problem, and clear photographs where possible.
• Where a claim is valid, we may offer repair, replacement, price reduction, refund, or another appropriate remedy depending on the circumstances and applicable law.
• Nothing in these Terms limits or excludes any mandatory consumer rights or legal remedies that apply under law.

7) Custom Commissions, Logos, and Submitted Materials

• If you submit logos, team references, names, artwork, images, or other materials, you confirm that you own them or have the necessary permission to use them for the commissioned work.
• You must not submit material that is unlawful, defamatory, infringing, hateful, obscene, or otherwise improper.
• We reserve the right to refuse any commission that, in our reasonable opinion, creates legal, ethical, reputational, or technical concerns.
• You retain ownership of your pre-existing intellectual property. You grant us a non-exclusive licence to use, resize, adapt, process, and reproduce the submitted materials solely for the purpose of producing your order, corresponding with you, and providing after-sales support.
• Unless otherwise agreed in writing, our underlying production files, print settings, support structures, slicing data, internal mockups, and production methods remain our property even where a physical custom item is sold to you.

7.1) Images of Finished Work

We may photograph or display standard WiggleKin products, sample pieces, or non-confidential finished work for portfolio, marketing, social media, or promotional purposes. If your order is commercially sensitive or you require confidentiality for a custom commission, please notify us in writing before production begins and we will consider the request in good faith.

8) Product Use and Safety

• WiggleKin items are collectible products. Unless a product page expressly states otherwise, they are not intended for rough play, high-impact use, or safety-critical applications.
• Some items may contain small parts, rigid elements, pointed features, magnets, adhesives, or breakable sections and may not be suitable for very young children without adult supervision.
• Keep products away from excessive heat, open flame, and environments likely to deform, weaken, or damage printed materials.

9) Website Use & General Terms

• You may use the Site only for lawful purposes and for genuine enquiries and purchases.
• You must not misuse the Site, interfere with its operation, attempt unauthorised access, upload malicious code, or use automated means to extract data unless expressly permitted by us in writing.
• If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account.
• We may suspend or restrict access to the Site if we reasonably suspect misuse, fraud, unlawful activity, or breach of these Terms.

9.1) Copyright Notice

All Site content, including text, product descriptions, photographs, logos, graphics, branding, illustrations, page layouts, and non-user-generated designs, is the intellectual property of WiggleKin, Gozo Graphics Ltd., and/or its licensors, and is protected by applicable intellectual property laws.

9.2) Use Restrictions

You may not copy, distribute, reproduce, adapt, resell, scrape, or commercially exploit Site content without prior written consent except as permitted by law.

9.3) Links to Other Websites and Services

Third-party links and services are provided for convenience only. We do not control them and are not responsible for their content, availability, security, or privacy practices.

10) Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, machinery failure, labour disputes, supply interruptions, internet outages, customs delays, governmental actions, carrier failures, or utility outages.

11) Limitation of Liability

To the fullest extent permitted by law, WiggleKin and Gozo Graphics Ltd. shall not be liable for any indirect, special, incidental, punitive, or consequential damages, including loss of profit, business, goodwill, opportunity, or anticipated savings.
Subject always to any mandatory rights you may have under applicable law, our total liability arising out of or in connection with any order, product, or use of the Site shall not exceed the amount paid for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12) Indemnity

You agree to indemnify and hold harmless WiggleKin and Gozo Graphics Ltd. from claims, liabilities, costs, and expenses arising from materials you submit, your unlawful use of the Site, your infringement of third-party rights, or your breach of these Terms.

13) Entire Agreement and Severability

These Terms, together with the Privacy Policy, Cookie Policy, Shipping & FAQ page, and any product-specific terms expressly referred to on the Site, form the entire agreement between you and us in relation to the Site and your order.
If any provision is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14) Governing Law and Jurisdiction

The laws of Malta govern these Terms. Subject to any mandatory consumer rights and rules of applicable law, disputes arising from or related to these Terms, the Site, or any order shall be subject to the jurisdiction of the courts of Malta.

Section B — Privacy Policy (GDPR-Aligned)

This Privacy Policy explains how Gozo Graphics Ltd. trading as WiggleKin (“we”, “us”, “our”) collects and processes personal data when you use WiggleKin.com, place an order, request a quote, submit a custom commission enquiry, or otherwise interact with us.
This Policy is intended to align with the EU/EEA GDPR and Maltese law.

• Identification & contact data: full name, email, phone number, billing address, shipping address, country.
• Account data: username, account profile details, saved preferences, and login-related information if you create an account.
• Order & transaction data: products ordered, quantities, order history, payment status, invoices, VAT details, dispatch details, and refund history.
• Commission data: logos, names, images, colour choices, project notes, and reference materials submitted for custom work.
• Communications data: emails, contact-form submissions, support requests, and related correspondence.
• Usage/device data: IP address, browser type/version, device identifiers, pages visited, timestamps, and diagnostic or analytics data.
• Cookies & similar technologies: identifiers used for consent management, functionality, analytics, and marketing where applicable.

3) Purposes and Legal Bases

• To provide and maintain the Site and any account features: Art. 6(1)(b) contract and/or Art. 6(1)(f) legitimate interests.
• To process and fulfil orders, quotes, and commissions: Art. 6(1)(b) contract.
• To communicate with you about orders, support, and service updates: Art. 6(1)(b) contract and/or Art. 6(1)(f) legitimate interests.
• To process payments, maintain records, and comply with accounting/VAT obligations: Art. 6(1)(c) legal obligation and Art. 6(1)(b) contract.
• To prevent fraud, secure the Site, and protect our rights: Art. 6(1)(f) legitimate interests.
• To send marketing communications about similar products or updates: Art. 6(1)(f) legitimate interests and/or Art. 6(1)(a) consent where required. You may opt out at any time.
• To use non-essential cookies, analytics, or advertising technologies: Art. 6(1)(a) consent where required.

4) Cookies and Similar Technologies

We may use session and persistent cookies for essential site functions, preferences, analytics, and marketing. Where cookies are not strictly necessary, we intend to request your consent through our cookie controls and record your preferences accordingly.

5) Sharing of Personal Data

• Service Providers / Processors: hosting, website tools, payments, communications, customer support, logistics, analytics, and related technology providers acting on our instructions.
• Professional advisers: accountants, insurers, legal advisers, or auditors where reasonably necessary.
• Business partners or subcontractors: only where necessary to deliver a requested service or fulfil a specific order.
• Public authorities: where required by law or where necessary to protect rights, safety, security, or investigate fraud.
• Corporate transactions: if our business or assets are restructured, financed, merged, or sold, subject to appropriate safeguards.

6) International Data Transfers

Personal data may be processed in Malta and in other countries where our service providers operate. Where personal data is transferred outside the EU/EEA, we will seek to apply appropriate safeguards required by law.

7) Retention

We retain personal data only for as long as necessary for the purposes set out in this Policy, including order fulfilment, customer support, dispute resolution, fraud prevention, and compliance with legal, tax, and accounting obligations.

8) Your GDPR Rights

You also have the right to lodge a complaint with Malta’s supervisory authority, the Information and Data Protection Commissioner (IDPC).

9) Automated Decision-Making & Profiling

We do not make decisions producing legal or similarly significant effects about you solely by automated means. We may use limited analytics or preference-based profiling for marketing or website improvement where permitted by law and, where required, where you have consented.

10) Children’s Privacy

• The Site is not intended to knowingly collect personal data from children in breach of applicable law.
• If you believe a child has provided personal data unlawfully, please contact us so that we can investigate and, where appropriate, delete the data.

11) Security

We use commercially reasonable technical and organisational measures to protect personal data. However, no method of transmission or storage is completely secure.

12) Links to Other Websites

Third-party websites and services linked from the Site are not operated by us. We are not responsible for their content or privacy practices and encourage you to review their own policies.

13) Changes to this Privacy Policy

We may update this Policy from time to time. We will post updates on this page and amend the “Last updated” date where appropriate.

If you wish to exercise your eligible right of withdrawal for a standard, non-personalised consumer order, please email dragons@wigglekin.com before the end of the applicable withdrawal period.

Please include the following details:

• your full name;
• the email address used for the purchase;
• your WiggleKin.com account username;
• your order number and order date (if applicable);
• a clear statement that you wish to withdraw from the purchase.

We may request further information where reasonably necessary to identify the order and process your request.
